Item I Give and bequeath to my beloved Sons James & Jonathan Maltbie, my House I bought of Titus Parker, with the orchard thereto adjoining, with the Meadow, as it is now inclosed, laying to the Eastward of the Orchard, butted & bounded Southerly by the Highway & Easterly by the Highway that Leads to Wallingford with all the Building & appurtenances thereto belonging to Each Piece of Land, equally divided between my two Last mentioned Sons.

Item I give & bequeath to my beloved Daughter Abigail Tyler half an Acre of Land, Laying as mentioned in the Deed on which she now Lives & over and above the movables that I have already given her, I give and bequeath to her One Cow and a pair of Hand Irons And moreover I give and bequeath to my three mentioned beloved Sons all my Lands in Branford and my Properties Right, to be equally divided among them, as they Can agree (Excepting a Lot laying upon the Great Hill, as it is now fenced in, near the little Gulf, containing about Six Acres, which I give to my Eldest Son Sam_ll_ Maltbie as an acknowledgement of his Birth Right,and also I give him out of my movables my House Clock, and One Silver Spoon which was my honoured fathers - - And I give to my Second James, out of my movables, my Desk and One Silver Spoon mark'd with my Honoured fathers Name - - - - - - - - - - - - - - - - And to Jonathan my 3rd Son I give my Case of Bottles & my half bushel and one Silver Spoon marked as the above - - - - - - - - - - - - - - - - - - - The remaining part of my movables, my Will & pleasure is that they be equally divided between my three Sons - - - - - And lastly I constitute make & ordain my Son Samuel Maltbie of Branford my Executor of this my Last Will & Testament, & I do hereby utterly disavow, revoke & Disarmul all and Every other former Testaments, Will, Legacies, and Bequeaths, & Executors, by me in any wise, willed and bequeathed, Rattifying & Confirming this & no other to be my Last Will & Testament in Witness whereof I have hereunto set my hand & Seal the Day & Year above written.

rever_d_ Mr. Bela Hubbard, one of the Subscribing Witnesses to the foregoing Instrument & made Solemn Oath that he saw Mr Samuel Maltbie late of Branford Dec_d_ Sign & Seal_d_ Instrument & heard him publish the same for and his last Will & Testament, & that he was of Sound mind and Memory when he so did & that Stephen Peck jun_r_ & John Linsly, the other Subscribing witnesses with the Deponent all subscribed as witnesses to said Will in the presence of the Testator and of Each other - - - - before me John Hubbard Just of Peace - December ye 22 Day 1770 Personally appeared John Linsly ye 3rd and made solemn Oath that he saw ye Testator of the within Will Execute the Same heard him declare it to be his Last Will & Testament & that He signed his name to it as one of the Witnesses in presence of the Testator & that he judged at that time to be of perfect Mind & Memory Sworn be fore me Josiah Roger Justice Peace

The Above Will & Testatment of Sam_ll_ Maltbie, late of branford dec_d_ was Exhibited & being Proved was approved in Court, and ordered to be Recorded & Samuel Maltbie named Executor therein by his Letter to this Court declared that Accepted the Trust therein Committed to him - - - - - - - - -"
